Village Board Tidies Up Smoking Ordinance


Park Forest, IL–(ENEWSPF)– The Park Forest board finalized the smoking ordinance at last Monday's board meeting to ensure that Bixby's and Tattler's are grandfathered.  Following initial passage of the ordinance, Village Manager Tom Mick noted that one of the establishments actually holds a Class A1 Liquor License instead of a Class A2 Liquor License.  The smoking ordinance contains an Effective Date and Transition Clause that was tweaked by this action of the board.  This all amounted to changing the line, "This Ordinance shall not be effective as to the premises of the two establishments holding a Class A2 liquor license and which are also a Restaurant at the time this Ordinance becomes effective."  The new language reads:

This Ordinance shall not be effective as to the premises of the two establishments holding a liquor license allowing the sale and consumption of liquor on the premises and which are also a Restaurant at the time this Ordinance becomes effective. 

Village President John Ostenburg announced that the businesses of Bixby’s and Tattler’s are exempt from the smoking ordinance, but a notification to the public must be clearly posted outside each facility that smoking is permitted.  Harold "Skip" Schmalz, owner of Bixby’s in Park Forest , expressed his gratitude for the Village’s decision, “Thank you to the village not for necessarily making a decision that was in our favor, but for your time.”
