New Approach Oregon: Sean Spicer’s Comments on Marijuana Troubling, But Don’t Necessarily Reflect Major Policy Change

Background

  • Press Secretary Sean Spicer affirmed the Trump’s Administration policy of respecting states’ rights to implement medical marijuana laws during a February 22nd press briefing.
  • When asked, “Is the federal government going to take some sort of action around this recreational marijuana in some of these states?” Press Secretary Sean Spicer answered, “I think that’s a question for the Department of Justice. I do believe that you’ll see greater enforcement of it.” He then goes on to say that he thinks the Justice Department will be “further looking into” recreational use.

  • “While concerning, the statements by Press Secretary Sean Spicer don’t guarantee a major policy change on marijuana by the federal government. We still need to hear directly from Donald Trump or Attorney General Jeff Sessions.”
  • “Greater enforcement by the Justice Department, if it does occur, could mean that the federal government may just monitor state-regulated businesses more closely. Potentially federal charges could be brought if cannabis businesses violate state law and regulations, such as selling marijuana to minors under the age of 21.”
  • “Legalization advocates should take the opportunity to be vigilant about protecting the will of the voters by contacting their legislators and letting the White House know that they, along with over 70% of Americans, want the federal government to respect states’ cannabis laws.”
