League Program “Incompatibility of Offices” Garners Crowd


Park Forest, IL—(ENEWSPF)— On a beautiful Saturday afternoon (11/10), about 45 people gathered in the board room of Park Forest Village Hall to hear Michael Luke, a Senior Assistant Attorney General and Chief of the Attorney General’s Opinions Division, discuss the issue of "Incompatibility of Offices," which refers to an individual holding two or more offices — which may or may not be compatible. This topic is obviously of interest to residents of the south suburbs!

Mr. Luke explained that two offices would be considered incompatible if a statute specifically prohibits the occupant of either one of the offices in question from holding the other. However, he explained that more often a subjective test would apply, based on the "doctine of incompatibility." Incompatibility of two offices is present "where the duties of either office are such that the holder of the office cannot in every instance, properly and fully, faithfully perform all the duties of the other office." Mr Luke described some ways in which this situation can be addressed.

Mr. Luke’s detailed and informative presentation was followed by questions from the audience, many regarding specific offices. His presentation was video recorded for showing on local public access television and will soon be available on Channel 4 for both Park Forest and University Park. Watch your local listings!
