Sierra Club: Supreme Court Accepts Petition on Demand Response Resources


WASHINGTON, D.C. –(ENEWSPF)–May 4, 2015.  Today, the Supreme Court granted a petition to hear a case on demand response resource compensation in Federal Energy Regulatory Commission (FERC)-regulated wholesale energy markets.

In response, Sierra Club Staff Attorney Casey Roberts released the following statement:

“Demand response is an essential part of an affordable, resilient, and cleaner electric grid. By granting this petition, the Court is taking a step in the right direction, and we are hopeful they will reject the lower court’s flawed decision.

“The D.C. Circuit’s decision to invalidate FERC’s order on demand response participation in wholesale energy markets threatens to slow the growth of this valuable resource.

“We believe that upon careful review, the Supreme Court will find that FERC was well within its authority in adopting this order and taking steps to strengthen the grid for our clean energy economy.”
